If someone hits a golf balll onto my property does it become mine?

Posted on June 16th, 2010 by admin

I can refuse them the right to come on my property, can’t I?

If your property is separate from the golf course (as in you don’t live in a golf community) then, yes you could legally post no trespassing signs and insist that the balls are your. Not a great way to make friends, but if you want all of those golfers to think you are some kind of embittered old fogey, go ahead. If it were me, I’d put up a sign that says that your lawn on OB, it’s OK to pick up the ball, but please don’t hit from your property.

If you live on a golf course the chances are that this happens often. I always give the balls back, I have a notice giving them permission to retrieve the ball providing the property is not damaged. This has always been my policy, up to now I have had no problems. On the notice in small print is " Fix your slice" with a happy face, I see people chuckling sometimes.

Depends if there are any local rules of the golf course you are near?
Otherwise put up a "keep off-private" sign. Then the ball is yours and trespassers can be shot.

    Technically, yes.
As long as you can suggest "your property" being private property, and not the area surrounding a course that’s not specifically mentioned as "yours" on the property deed that could be considered "maintained areas" of the course (kind of like the "right of way" where the sidewalk is on most residential properties, that the homeowner don’t own either).

Just a little suggestion ——- oftentimes people that move onto golf courses turn into nazi’s because their homes get peppered or get angry over someone traipsing through their backyard – and I’m just going to say that you’re not going to make any friends that way, and it’s never going to stop unless you sit out there with a shotgun all day and post No Trespassing signs – and that perhaps you should have considered your locale relative to the course and golfers before purchasing the property. It’s a bit like moving next door to a school and complaining about kids cutting across your front yard.

Additional info: Played a course once, surrounded by homes, and one of my playing partners hit one into someone’s back yard. As we got up there, there was a little bucket on top of the little wall and it was full of golf balls, and had a sign that read, "PLEASE TAKE ONE (or two) TO REPLACE THE ONE YOU LOST, AND RESIST THE URGE TO TRAMPLE OUR FLOWERS OR ROOT AROUND IN THE SHRUBBERY."
Come to find out, the little old couple that lived there would go out and sit on their porch in the evenings over cocktails, smelling the flowers in the night air, and get up every now and then pick up a golf ball and deposit them in "the bucket." Everybody was happy, and best idea I ever heard of.

Yes you can. If you keep enough of them check with usedgolfballstore.com, they buy used balls.

But aren’t there better things you could with your time?

@robs4golf – I’ve seen the same thing. The Tour 18 in Houston has a home like that. It’s on the right side of the 12th fairway which is their version of Colonial’s #3. I vote that’s a great solution.
